Sub: Legal Notice under Section 138 of Negotiable Instruments Act, 1881
I, under instruction and on behalf of our client Mr. A , S/o xxxxxx R/o xxxxxxxx address you as under: .
- That my client is runs a leading music and singing classes in name and style of M/s Mr A’s Singing Classes.
- you had approached my client for imparting training in music and singing to your friend Mr. C. You had represented that Mr. C has a very good voice but is not a trained singer. You requested my client to train him in classical as well as modern singing.
- That you agreed to pay Rs. 1,00,000/- for those classes. In advance you had paid only Rs. 10,000/-. Rs 90,000/- has yet to be paid. A contract has been duly signed between you and my client.
- That after completion of training of Mr. C you issued a cheque bearing No. xxxxxxxx dated xxxxxxx drawn on xxxxxxxx for a sum of 90,000/-.
- That our client presented the aforesaid cheque for collection and same was returned unpaid by your banker with the remarks “Funds Insufficient” vide its cheque returning memo dated xxxxxxx.
- It is brought to your notice that as per the contents of chapter XVII of Negotiable Instruments Act, 1881 Section 138 (b), you can be imprisoned for a term which may extend to two years or with fine which may extend to twice the amount of the cheque(s) or with both, in case of dishonor of your cheque(s).
- That this notice is issued to you in terms of Section 138 (b) of Negotiable Instrument Act, 1881.
You are hereby called upon to pay our aforesaid client the Cheque amount of Rs.90,000/- within 15 days from the date of receipt of this notice, failing which our clients shall be forced to institute proceeding under Section 138 of Negotiable Instruments Act, 1881 against all of you.
A copy of this notice is retained in our office for further reference.
