APPLICATION FOR CONDONATION OF DELAY UNDER SECTION 5 OF THE LIMITATION ACT, 1963

MOST HUMBLY SHOWETH:

(1) That this application is being filed for condonation of delay of ______days in filing of accompanying application/appeal.

(2) That the Applicant was suffering from pneumonia and fever and as such visited Hospital on ………….. The  illness was so severe that the applicant was hospitalized and was in hospital from _________to ________.  The doctor also advised for bedrest for two months. Copy of the medical prescription is attached herewith and marked as Annexure A.

(3) That on account of aforesaid illness, there has been delay of ____________days in filing of accompanying application.

(4) That delay in filing of the accompanying application/appeal is not intentional or deliberate but on account of aforesaid sufficient cause.

PRAYER

In light of aforesaid facts and circumstances, it is therefore prayed that this Hon’ble Court may be pleased to:

(i) Condone the delay of _______________days in filing of the accompanying application.

(ii) Pass any order(s)/direction(s) as this Hon’ble Court may deem fit and proper in interest of justice.
